Guarding the Guards: What Welfare AI Reveals About the UK’s Regulatory Blind Spot

Did you know that: Under (Chapter II, Art. 5) EU AI Act, which most AI service providers comply with, are prohibited from: 


- "social scoring, i.e., evaluating or classifying individuals or groups based on social behaviour or personal traits, causing detrimental or unfavourable treatment of those people".



Computer Weekly article "DWP 'fairness analysis' revealed bias in AI fraud detection system" which states: "the assessment showed there is a 'statistically significant referral… and outcome disparity for all the protected characteristics analysed', which included people's age, disability, marital status and nationality"



Computing.co.uk  article "AI bias uncovered in UK welfare system" reported: "internal documents obtained through a Freedom of Information request show significant flaws in the AI system designed to streamline the process of verifying universal credit claims. A 'fairness analysis' conducted by the DWP uncovered 'statistically significant outcome disparities,' indicating that certain groups were more likely to be flagged for potential fraud"



The UK is operating what appears to be exactly the type of social scoring systems that the EU has deemed unacceptable risks to fundamental rights. The principles-based approach, whilst providing flexibility, has created a regulatory vacuum where systems causing demonstrable harm to protected groups can continue operating.


This represents a fundamental difference in approach: the EU has decided some AI practices are simply too dangerous to allow with safeguards, whilst the UK believes almost any AI use can be made acceptable with proper governance. The evidence suggests the UK approach isn't working to protect citizens from algorithmic discrimination.



Our UK Government is pushing for an all-out advancement in AI technologies, and that is great. But we do need Measures to "Guard the Guards" #EUAIACT #AIGovernance #AlgorithmicBias #DigitalRegulation #PublicSectorAI
